This agreement is between Nostalgia Photography, and the Client who signs this contract.

1. Retainer and Payment. The Client shall make a non-refundable retainer to the Photographer to perform the services specified herein. The fee is  $50 for mini & regular sessions, and half down for 1st year package. Upon payment, the Photographer will reserve the time and date agreed upon by both parties. The remainder is due at the session. The Client shall pay an additional travel fee for sessions more than 35 miles outside of the 63367 zip code.

2. Rescheduling. In the event that the Client requests to reschedule a session, the retainer shall be applied to a rescheduled session if notice is given at least 7 days prior to the scheduled event. If the rescheduling request is due to a Client illness, less notice may be allowed. The Photographer or Client may request to reschedule the session due to weather; discussion about the possibility of rescheduling should begin 24 hours prior to the session with a final decision made no later than 1 hour prior to the session. Rescheduled sessions must occur within the same calendar year.

3. Late Arrivals. Any Client that is late arriving to a session will have the amount of time late deducted from the time allotted for the session. This may also result in a reduction of the number of edited images.

4. Cancellation. If the Client cancels a session without rescheduling or fails to show for a scheduled session, the retainer shall be forfeited. Spring and fall minis can not be rescheduled, and retainer is forfeited at cancellation.

5. Schedule of Completion. Proofs shall be available to the Client approximately two weeks after the session.

6. Copyright and Reproductions. All photographic materials, including but not limited to unedited RAW files and edited JPGs, shall be the exclusive property of the Photographer. The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographers website, studio, etc. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of the Photographer.

7. Clients Usage. The Client shall only use the prints and products, including digital files, in accordance with the permissions within this agreement. The Clients prints are for personal use only and shall not be submitted to contests or reproduced for commercial use. The Client may not authorize any reproductions by parties other than the Photographer. The Client must act in accordance with the digital file print release that accompanies the images.

8. Social Media. The Client may share blog post links and Facebook albums through use of the share functions and dissemination of direct links. When sharing images please give Nostalgia Photography credit. Please no screen shots, no filters, no cropping, etc., as it misrepresents Nostalgia Photography.

9. Failure to Perform. If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability.

10. Indemnification. The Photographer shall be held harmless for any and all injury to the Client during the course of the photography session and the immediately surrounding events.

11. Limit of liability: I take the utmost care with respect to the exposure, basic retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Nostalgia Photography’s control, the Photographer’s liability is limited to the refund of all payments received, or a re-shoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date. If the situation should occur, and the portrait session must take place on the scheduled date, Photographer will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.

12. After six months, all images will be purged from the photographer's hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer's sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond the photographer's control.

13. All gallery images are custom and creatively edited and ‘touched up’. Any additional retouching requests, beyond what has already been done and presented in your on-line gallery will be charged a fee of $100 per hour [$50 minimum].
Model Release
I hereby give to Nostalgia Photography (Jaimie Vaughan) the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:
a) To copyright the same in the photographer’s name or any other name that he/she may select;
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, and; I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
Note from Photographer: I work very hard to create images that reflect you and your family, while keeping in line with my artistic vision and creativity.  I would hope that you would want to share the images, however, I ask that you simply link back to my blog/Facebook page instead of right-clicking, saving, and sharing the image via your own page. It takes away from the quality of the image itself, and it is a misrepresentation of my work. I hope that you will respect not only my hard work, but the time, money, and dedication that I have put into training and equipment to capture these images for you. Thank you!
